Psychiatric Malpractice
Psychiatric malpractice occurs when a psychiatrist fails to use the same reasonable degree of knowledge and skill used by other psychiatrists. Suicide is the underlying injury which most often leads to psychiatric malpractice lawsuits, but is not the only harm that may be suffered due to psychiatric malpractice. A psychiatrist who fails to take proper precautions to protect a patient who threatens or shows signs of imminent suicide may give rise to a legal claim.
Psychiatrists are trained to pick up on signs of mental anguish, depression, and future suicide which may not be evident even to friends and family of the patient who may know him very well. They have a duty to carefully evaluate all of their patients and diagnose any mental illnesses the patient may be afflicted with. Often in cases of psychiatric malpractice, the psychiatrist fails to diagnose a mental condition, prescribes incorrect doses of medication, or fails to evaluate past records or information adequately.
